By Your Side Every Step Of The Way In Your Divorce

I am Matthew Maddox of Maddox Law in McKinney, Texas, and I understand the emotional toll that comes with preparing for or going through a divorce. Even if you and your spouse are on good terms, the thought of going through the process can leave many people feeling defeated before they start. I am here to listen to your concerns and reassure you that we can find a way to make life feel right again.

If you feel angry and want to fight to win everything in the divorce, I can help you make sense of it all and help you understand what is realistically attainable. Sometimes in divorce, there are no winners or losers. There is finding a middle ground where you and your financial future are protected as much as possible. However, if I know we can win something, I will fight hard for it. I won't let you give up something if you don't have to.

What Can I Expect In A Texas Divorce?

Here is what you can expect in the Texas divorce process:

  • Grounds for divorce: Texas divorce laws allow for a no-fault divorce. This means that when you or your spouse file for a divorce, neither of you needs to show evidence that the other was at fault.

  • How long is the waiting period? There is a waiting period of 60 days after the suit was filed.

  • An attorney can help with property division. It can be a huge undertaking to try to figure out what is marital property that will be divided, and what is individual property. That along with other assets, bank accounts, retirement accounts, businesses and many other things need to be evaluated in the process.
  • If you have children, an attorney can help fight for the custody or visitation plan that you hope for. If I as an attorney think the goal is unattainable, I will be honest with you and help us find a middle ground where you still have results that are in your best interest.
  • After the divorce decree is signed, neither you nor your spouse may remarry before the 31st day after it was signed, unless this is waived by the court.
  • If your spouse does not follow the custody or child support agreements set by the court, an attorney can help enforce or modify the agreements.
